The only way to buy or sell a home privately is by means of a signed agreement. In Dutch law there is, in a legal sense, no binding agreement as long as there is no signed contract. Therefore, make sure that this is done properly. You may deviate from most conditions provided that both parties agree, but if not, what has been agreed in writing applies.<\/span><\/p>\n

First of all, it is about fixing the price and delivery. But what exactly has to be delivered and who is liable to what extent? Sellers have a so-called duty to report, but buyers also have their own duty to investigate. What exactly do you record and how do you do that so that what is intended is properly and legally correct on paper.<\/p>\n

Resolutive conditions are included. For example, the reflection period. In addition, the best known is the financing reservation. But of course a seller wants the financing to be seriously examined and not too lightly dissolved. Buyer does not want to be faced with impossible requirements if they have to be dissolved. A building inspection is also often used as a condition, or the sale of an owner-occupied home, the so-called ‘no-risk’ clause.<\/p>\n

The purchase agreement contains: the details of the seller and buyer, which property it concerns, cadastral data, the purchase price, the date of delivery and matters such as resolutive conditions in connection with the financing or a housing permit, soil pollution, etc.<\/p>\n

We obtain the cadastral documents and provide a list of movable property (what remains behind and what is not?) together with both parties and a questionnaire with information about the house.<\/p>\n<\/div>\n<\/div>\n
